The charges and credits set forth in this Schedule will be adjusted annually for any increase in labor costs as compared to the previous year.
During the Term, if the Employee Cost Index (ECI), as
published by the Bureau of Labor Statistics of the Department of Labor
("ECI"), as of May 1st of each year (the "Current Index")
is higher than the index as of May 1st of the previous year (the "Comparative
Index"), then, effective as of June 1st immediately following, such
charges and credits then in effect shall be increased by percentage increase
the Current Index exceeds the Comparative Index. The first adjustment
shall take place June 01, 2007.
In terms of a clarification of the Index being used for SOC Code Number
11-3021, we have selected United States Department of Labor, Bureau of
Labor Statistics, Table 5. Wages and Salaries (Not Seasonally Adjusted),
Occupational Group, White collar, Professional specialty and Technical
as the index.
If the Bureau of Labor Statistics ceases publication or materially and substantially changes the content or the format of ECI, the Parties may substitute a mutually agreeable comparable measure published by a mutually agreeable source; provided, however, that if such change is merely to redefine the base year for the ECI from one year to some other year, the Parties shall continue to use ECI, converting the relevant indices to the same basis as the new base index by multiplying the relevant indices by an appropriate conversion factor.
